Deep State Games Inc. License Agreement

PLEASE READ THIS SOFTWARE LICENSE AGREEMENT ("LICENSE") BEFORE USING THE SOFTWARE. BY USING THE SOFTWARE, YOU (LICENSEE) ARE AGREEING TO BE BOUND BY THE TERMS OF THIS LICENSE. YOU ARE ACCESSING THE SOFTWARE ELECTRONICALLY, AND YOU SIGNIFY YOUR AGREEMENT TO BE BOUND BY THE TERMS OF THIS LICENSE UPON DOWNLOADING THE SOFTWARE APPLICATION.

Unless explicitly stated in writing, you are receiving a non-transferable, non-exclusive, revocable, limited license in which Deep State Games Inc. does not grant permission to distribute the software for profit in any form, including but not limited to, electronic information service distribution, bulletin board distribution, and magnetic or optical medium distribution.

Unless otherwise stated in writing, if you obtained the Licensed Application from the Apple App Store, you are permitted to use the Licensed Application on any Apple-branded Products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the Licensed Application may be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing. If you obtained the Licensed Application from Google Play, you are permitted to use the Licensed Application on any compatible devices that you own or control, as permitted by the Google Play Terms of Service, including Google Play Family Library where available.

Deep State Games Inc. is not responsible for any damage to the user's mobile phone, tablet or computer system data, and in no event will Deep State Games Inc., Apple Inc., Google LLC, or their respective officers, directors, employees or agents be responsible to the user for any consequential, incidental, or indirect damages (including damages for loss of business profits, business interruption, loss of business information and the like) arising out of the use or inability to use the Licensed Application, even if Deep State Games Inc. has been advised of the possibility of such damages. Because some states do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitations may not apply to you.

Deep State Games Inc., and not Apple or Google, is responsible for any product warranties with respect to the Licensed Application, whether expressed or implied by law. In the event of any failure of warranty by law, neither Apple nor Google will have any warranty obligation with respect to the Licensed Application.

Deep State Games Inc., and not Apple or Google, takes full responsibility for addressing any End-User or third party product claims pertaining to the Licensed Application, including, but not limited to, product liability claims; claims regarding legal or regulatory requirements; or claims arising under consumer protection, privacy, or similar legislation.

In the event of any third party claim that the Licensed Application or the End-User's possession and use of that Licensed Application infringes a third party's intellectual property rights, Deep State Games Inc., and not Apple or Google, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim. The End-User must comply with applicable third party terms of agreement when using the Licensed Application.

Third Party Beneficiaries. If you obtained the Licensed Application from the Apple App Store, your acceptance of this License Agreement acknowledges that Apple and Apple's subsidiaries are third party beneficiaries of this EULA, and that upon your acceptance of its terms and conditions, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third party beneficiary thereof. If you obtained the Licensed Application from Google Play, your use of the Licensed Application is also subject to the Google Play Terms of Service, and Google LLC is not a party to this EULA.

As the Licensed Application End-User, and to adhere to Legal Compliance, you warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

Deep State Games Inc. shall be responsible for all maintenance and product support with respect to the Licensed Application, as specified in this EULA or as required under law. Upon acceptance of this agreement, both parties acknowledge that neither Apple nor Google has any obligation to furnish any maintenance or support with respect to the Licensed Application.
